The Philippine Councilors League Region 6 Federation of Officers from the six provinces and two highly-urbanized cities of Iloilo and Bacolod elected its officers for 2013-2016 in Iloilo City headed by Councilor Mitchelle Patricio of Pilar, Capiz as regional chairman recently, its press release said.
The other officers who ran unopposed are Sherwin Sancheng of Iloilo province, regional vice chairman; Renante Nava, Antique, secretary general; Nelly Rentoy of Guimaras, treasurer; Jay Tejada of Aklan, auditor; and Wilfredo Tortosa of Negros Occidental, public relations officer, the press release also said. A resolution requesting the City Legal Office and its Enforcement Unit, the Bureau of Fire Protection and Bacolod City Police Office through the Office of the City Mayor to implement City Ordinance No. 511, Series of 2009 regulating the manufacture, sale and use of firecrackers and pyrotechnics in Bacolod City, was approved by the Sangguniang Panlungsod Wednesday.
The resolution authored by Councilor El Cid Familiaran, chairman of the SP Committee on Peace, Security and Jail Management, said that among the positive things that the Christmas celebration brings is that it stimulates business in the city and provides more benefits or business opportunity to the people. It said these businesses also involve the sale of firecrackers and pyrotechnics. However, the manufacture, sale and use of firecrackers and pyrotechnics pose danger, not only to the buying sector, but to the general public and should be strictly regulated through existing laws. To prevent untoward incidents that may cause fire due to fire crackers and pyrotechnics, the enforcement of C.O. Councilor El Cid Familiaran said in his welcome speech that the position of the city is in harmony with his advocacy, even before he was elected member of the Sangguniang Panlungsod. THE VISAYAN DAILY STAR Three Kagawads of Barangay Alangilan in Bacolod City have requested the Bacolod Sangguniang Panlungsod to allow them to appear at its regular session today to air their opposition to the construction activity at the Metro Safari Resort despite their vehement opposition to its its failure to comply with the mandatory requirements of the law.
Kagawads Donard Alimpolo, Alex Sauci and Roy Retiza, in a letter to the SP, said Metro Safari Resort in Brgy. Alangilan has not complied the required Environmental Compliance Certificate, building permit, and City Planing and Development Office clearance . They said that, despite the order of the Sanggunian for the immediate stoppage of the construction activities on the site, it is being continued, in open and blatant defiance of the authority of the Barangay Council of Alangilan and the City of Bacolod. Worse, the Office of the Building Official did not lift a finger to stop the on-going construction that was witnessed by no less than Councilor El Cid Familiaran and themselves, they said. The illegal construction continues to be committed by the owner in apparent violation of PD 1096 and in complete disregard of the mandate of the City Council. They therefore are requesting for an opportunity to appear before the Council with acting OBO head Isidro Sun who allegedly continues to ignore and disregard the Resolution of the Sanggunian and Barangay Council to stop the illegal construction, the kagawads also said. They also requested the presence of Police Station 5 Commander as the construction continues to violate P.D.1096 and is being done in "flagrante delicto" by the owner and the contractor. Thus, they also said, the police officers and even private citizens can effect a citizen's arrest against these violators who feel that they are over and above the law. Meanwhile, Sun said they have already issued Metro Safari Resort a notice of violation after an inspection conducted by their building inspector in the area Saturday, since the resort had also failed to secure a business permit for the construction of the foundation of a water tank. Sun said the notice of violation was received by a representative of Metro Safari Resort Monday and if there is no compliance after 15 working days, they will issue a second notice of violation. Aside from that, a number of vehicular accidents ensued resulting in injuries to people. Those accidents and injuries should have been avoided had the Circumferential Roads been provided with traffic enforcers to insure the order of traffic, he said. Hence, to have a smooth traffic flow in the Circumferential roads and prevent further untoward accidents which may involve commuters, the presence of traffic enforcers is urgently needed. In their letter to Sun, Kagawads Donard Alimpolo, Alex Sausi and Roy Retiza said they are giving the OBO five days to issue a notice of work stoppage to MSR, otherwise, they will be forced to file charges for violation of Presidential Decree 1096, or the Anti-Graft and Corrupt Practices Act and Abuse of Authority, against him and “all those people involved in this illegal activity” before the office of the deputy Ombudsman for the Visayas. The barangay officials stressed that this request is made in accordance with the recommendation made by the Committee on Laws and Ordinances of the Sangguniang Panglungsod of Bacolod, headed by Councilor Caesar Distrito. They said no less than Councilor El Cid Familiaran had presented pictures he took of the ongoing constructions in the area during the committee hearing on November 28, but until now, OBO has not taken any action on their complaint. They claimed that when they complained to Sun, he just inquired why they were running after the project. Contacted by the DAILY STAR, Sun denied having said that, and claimed that no one went to his office to personally complain against the MSR construction. Sun reiterated that the office cannot issue notice of work stoppage to MSR because there is no construction to begin with. He said that once MSR starts construction without permits, then they will issue the notice. As to the charges being posed by the officials, he said, it is their right to do so but said they are “making sure” before issuing a notice of stoppage to MSR, that there are enough evidences. Sun said that unless he sees a steel bar being erected at the site, he cannot issue a work stoppage or else he will be technically charged. Bacolod Councilor Caesar Distrito has directed the Office of the Building Official to issue a notice of violation and work stoppage to the Metro Safari Resort in Brgy. Alangilan, Bacolod City, for it to desist from the ongoing construction, and to require it to comply with the required permits.
Distrito, chairman of the Bacolod Sangguniang Panlungsod Committee on Laws, Ordinances and Good Government, also recommended that the resort, owned by Francis Rey Cabuga, should temporarily stop its development, while they are complying with the necessary government permits. This includes a building permit from the OBO, Environmental Compliance Certificate from the Environmental Management Board – Regional Office, City Planning and Development Office certification, resolution of favorable endorsement from the barangay, and Department of Agrarian Reform conversion clearances. A committee hearing was conducted Friday by Distrito to address the complaint of Alangilan Kagawads Donard Alimpolo and Alex Sausi, who asked to be guided if the initiative made by the owner of Metro Safari Resort is legal and if it has complied with the requirements prescribed by law. The complainants said the Alangilan Barangay Council denied the request of Cabuga for a favorable endorsement from the barangay to put up a resort after they were told by DAR that the conversion of the agricultural land without its approval is irregular. They said they were surprised and felt insulted to receive an invitation to the groundbreaking on Sept. 13 from the proponent, despite the denial of their request by the barangay officials. During the committee hearing, Harlan Tugot of the DAR told Distrito that there is no pending application for DAR clearance in their office from Metro Safari Resort, and the place where it is located is considered a CARP area. Ignacio Cabayao Jr. said there should be no activity done before the approval of the conversion order and that a zoning clearance should be requested by the owner from the CPDO. Jose Dureza, representative of OBO, informed the body that, as of the moment, their office has not received any application for a building permit from Metro Safari Resort. Ma. Cecilia Soriano, legal counsel of Cabuga, said the materials for construction are ready, but no actual construction is happening yet. But Sausi said there are already existing structures in the area and he even saw that construction of the other structures had already started. Soriano said there was an existing fence in the area helping the purchase of the property. However, Councilor El Cid Familiaran showed pictures of the area where Metro Safari Resort is located, that he took before attending the committee hearing, and they showed ongoing construction activities in the area. Raymund Quinto, executive assistant of Metro Safari Resort, said the construction of the foundations of the establishment had already started. But when asked by Distrito if they had secured a building permit, he answered that they are still processing it. Edgardo Rostata of the City Environment and Natural Resources Office told Distrito that DENR regional director Jonathan Bulos informed him that their office has not received any application for ECC from Metro Safari Resort. Ana Ma. Carmen Principe, CPDO officer-in-charge, said that, based on City Ordinance 216, the area is classified as agricultural land. CPDO Zoning officer Francis Aranez said that before construction, a zoning clearance should be requested from their office and if the area will be converted from agricultural to parks, C.O. 216 should be amended.*CGS |
