AN ORDINANCE PROHIBITING BUSINESS ENTITIES & PERSONS CHARGING FEES FOR THE USE OF TOILETS, COMFORT ROOMS OR RESTROOMS TO SENIOR CITIZENS AND PERSONS WITH DISABILITIES(PWDs) IN THE CITY OF BACOLOD
WHEREAS, because of the age of senior citizens and handicap of persons with disabilities, they are considered the most marginalized & vulnerable sectors of society;
WHEREAS, senior citizens and persons with disabilities are forced to look for free toilets, comfort rooms or restrooms because certain establishments in the City require them to pay first before peeing;
WHEREAS, requiring fee of elderly and persons with disabilities for peeing would put them at great disadvantage since they are less mobile and capable of walking further in order to respond to the call of nature;
WHEREAS, this particular situation of senior citizens and persons with disabilities calls for the City’s intervention and resolution;
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod in the City of Bacolod in session assembled, that:
Section 1. Title. – The title of this Ordinance shall be known as, “An Ordinance Prohibiting Business Entities and Persons Charging Fees for the Use of Toilets, Comfort Rooms or Restrooms to Senior Citizens and Persons with Disabilities. Its short title shall be known as , “Free Toilet Use for Senior Citizens & PWDs Ordinance.”
Section 2. Definition of Terms –
a. Persons with Disabilities or PWDs – refer to those persons who are suffering from restriction or different disabilities, as a result of a mental, physical or sensory impairment, to perform an activity in the manner or within the range considered normal for a human being.
b. Senior citizens or elderly – refers to any resident of Bacolod City who reach the age of 60 and beyond.
Section 2. Policy. – It shall be unlawful for any person(natural or juridical) in the City of Bacolod to charge fees to any senior citizen and person with disabilities using toilet, comfort room or restroom.
Section 3. Requirement for availmentt. – A senior citizens resident of the City shall present his/her Senior Citizens ID issued by the Office of Senior Citizens Affairs (OSCA) to the attendant of any establisment in the City which requires people to pay for the use of toilet, comfort room or restroom.
Persons with disabilities may inform the attendant that they wish to use the toilet, comfort room or restroom, so that if necessary they may be assistted.
Section 4. Posting of Sign or Notice to All Establishments, Toilet, Comfort Room or Restroom. – A sign or notice must be posted to the following:
a. For Bus/ Jeepney Terminal – “FREE OF CHARGE FOR SENIOR CITIZENS AND PWDs,” and
b. For Malls/ Stores/Restaurants – “FREE OF CHARGE FOR SENIOR CITIZEN & PWD CUSTOMERS OR CLIENTS.”
Section 5. Fines or Penalty. – Persons, including juridical persons, such as managers of private establishments or corporation who violate this Ordinance shall be fined Three Thousand Pesos (3,000.00) or an imprisonment not to exceed One(1) Year or both, at the discretion of the Court. The same penalty shall apply for failure of posting synnage as provided in the preceeding section, hereof.
Section 6. Separability Clause. – If any provision of this Ordinance is held invalid, provisions which are not affected shall remain in full force and effect.
Section 7. Effectivity Clause. – This Ordinance shall take effect after 15 days after publication in the newspaper of local circulation.

AN ORDINANCE INCREASING THE ALLOWANCE OF THE BARANGAY HEALTH WORKERS(BHWs) IN THE CITY OF BACOLOD
WHEREAS, health is a primordial concern of everybody, as most of the health speicailists said that, “health is wealth;”
WHEREAS, while maintaining physical health is the concern of those who can afford, nonetheless, for ordinary people they usually rely in the barangay attended to by the barangay health workers;
WHEREAS, because of the volume of people who usually trooped to the barangay that seek health & other services, barangay health workers found themselves in the midst of work, normally attending their fellow barangay folks need, more often go home in late;
WHEREAS, the unselfishness of the barangay health workers who perform barangay health services & other related work, at times voluntary, and considered hazardous, many of which are assigned to by the National or the City government. And, although, each is provided already with Php 2,000.00 monthly allowance, however meager it is, and not even enough for fares and other exigencies while performing their daily tasks;
WHEREAS, such situation of the BHWs calls for the review of their allowance being provided by the City;
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of Bacolod City in session assembled, that:
Section 1. Title. – The title of this ordinance shall be known as, “An Ordinance Increasing the Allowance of the Barangay Health Workers (BHWs) in the City of Bacolod.”
Section 2. Definition of Terms. –
(1) Barangay Health Worker (BHW) - refers to a person who undergone health or related training by the government or private entities that renders barangay-based health & related services.
(2) Hazard – refers to the risks involved in work, unit/ place or station of work where barangay health worker is assigned or rendered work or services.
Section 3. Policy. – It is the policy of the City to provide living wage to its employees, extend and or increase allowance to the Barangay Health Workers and provide them incentives as they often perform hazardous work.
Section 4. Increase of Allowance and Incentives. – The City shall allocate funds for the increase of monthly allowance of the Barangay Health Workers from Php 2,000.00 to Php 3,500.00.
Section 5. Submission of a List of BHWs & Disbursements. – The City Treasurer’s Office shall disburse monthly allowance of the Barangay Health Workers upon submission of monthly updated lists by the barangay treasurer concerned.
Section 6. Separability Clause. – If any provision of this ordinance is held invalid, provisions which are not affected shall remain in full force and effect.
Section 7. Effectivity Clause. – This ordinance shall take effect after 15 days after publication in a newspaper of local circulation in the City of Bacolod.

AN ORDINANCE AMENDING SECTION III OF CITY ORDINANCE NO. 210, SERIES OF 1998, “AN ORDINANCE ESTABLISHING POLICIES THAT SHALL GOVERN THE OPERATION AND MAINTENANCE OF THE HANDUMANAN PUBLIC CEMETERY AND PROVIDING VARIOUS FEES AND IMPOSING PENALTIES FOR VIOLATING THEREOF”
WHEREAS, City Ordinance No. 210, Series of 1998, “An Ordinance Establishing Policies that shall Govern the Operation and Maintenance of the Handumanan Public Cemetery and Providing Various Fees and Imposing Penalties for Violating Thereof” was approved and passed by the Sangguniang Panlungsod last January 28, 1998;
WHEREAS, section III of the above-stated Ordinance provides, that:
“ Handumanan Public Cemetery – a newly developed 4.0017 hectares (1.8355 has. Christian, 1.00 ha. Muslim, 1.1662 has. Buffer Strip) public cemetery managed by the City Government of Bacolod, ready as burial grounds.”
WHEREAS, per the above-stated information a big parcel of more than 4 hectares of land for public cemetery is devoted for Christians and Muslims, with still remaining “1.1662 hectares or 11,662 sq. meters” considered as buffer for pertinent uses;
WHEREAS, among the sectors by their condition which demand for these services from the City are our veterans;
WHEREAS, slicing a portion from this more than 4 hectares of land for the burial site of our veterans will also mean a lasting recognition for our war heroes during World War II;
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of Bacolod City in session assembled amending Section III of City Ordinance No, 210, Series of 1998, “An Ordinance Establishing Policies that Shall Govern the Operation and Maintenance of Handumanan Public Cemetery and Providing Various Fees and Imposing Penalties for Violating Thereof.”
Section 1. Amendatory Clause. – This is to amend Section III of City Ordinance No. 210, series of 1998 which shall be read, as follows:
“Handumanan Public Cemetery, a newly developed 4.0017 hectares(1.8355 has. Christian, 1.00 ha. Muslim, .200 ha. or 2,000 sq. meters shall be for war veterans and the remaining “.9712 ha. or 9,712 sq. meters” shall be considered as Buffer Strip) public cemetery managed by the City Government of Bacolod, ready as burial ground.”
Section 2. Miscellaneous Provisions. The following shall guide in the operation of a War Veterans Cemetery:
a. That the Two Thousand (2,000) sq. meters alloted for the war veterans cemetery shall be inclusive of pathwalks and a shed where to hold snacks and/ or similar activity,
b. That said lots shall be exclusively for the war veterans who are the residents of the City, and not for their widows or siblings, and
c. That for purposes of uniformity, burying at the War Veterans Cemetery shall be a “ground burial,” with similar size of cross & marker being provided by the City.
Section 3. Exemption from any Fee. - Required fees for burial shall exempt
the war veterans.
Section 4. Delineation and Particular Name of Cemetery.– A delineation of 2,000 sq. meters for veterans cemetery shall be permanently established.
This cemetery shall be known as, “The Bacolod War Veterans Cemetery”
Section 5. Budget. –
a. Initial Budget. – a budget of One Hundred Fifty Thousand (Php 150,000.00) Pesos shall be appropriated to establish an “ARCO” of the Bacolod War Veterans Cemetery.
Section 6. Effectivity Clause – This Ordinance shall take effect after 15 days after publication in the newspaper of local circulation.

AN ORDINANCE ESTABLISHING THE BOTIKA NG BAYAN UNDER THE SOCIO-ECONOMIC ENTERPRISE UNIT
WHEREAS, Section 15 of Article 2 of the 1987 Philippine Constitution provides that, “the State shall protect and promote the right to health of the people and instill health consciousness among them;”
WHEREAS, also the same Constitution, under Section 11 of Article XIII provides that, “the State shall adopt an integrated and comprehensive approach to health development, which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost;”
WHEREAS, following the above-stated constitutional mandate, the City Government of Bacolod shall establish a health program which shall be known as the Botika ng Bayan,which shall be situated at the Bacolod City Health Office Compound, whose operation, management & administration shall also be held;
WHEREAS, for such purpose, and in order to efficiently deliver such medical services to the concerned needy, this Ordinance thru its Implementing Rules & Regulations(IRR) shall provide a system of refund and/or discount for Senior Citizens and Philhealth cardholders & their beneficiaries who are admitted or confined at the public or private hospitals under the “Partner Pharmacy Scheme;”
WHEREAS, thru the Botika ng Bayan, an effective & affordable medicines & other medical supplies would be available to the Senior Citizens and Philhealth cardholders, especially the indigents & their beneficiaries under the “Partner Pharmacy Scheme.”
WHEREAS, as provided in Section 16 of Republic Act No. 7160 otherwise known as, the Local Government Code of 1991, particularly under its “General Welfare Clause.,” which states that, “every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate or incidental for its efficient and effective governance;”
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in session, that:
Section 1. Title. – The title of this Ordinance shall be known as, “An Ordinance Establishing the Botika ng Bayan under the Socio-Economic Enterprise Unit.”
Section 2. Establishment of the Botika ng Bayan. – The City of Bacolod thru this Ordinance, hereby establishes the Botika ng Bayan under the Socio-Economic Enterprise Unit to provide effective and affordable medicines and/ or medical supplies for Senior Citizens and Philhealth cardholders , especially the indigents & their beneficiaries who are admitted or confined at public and private hospitals.
Section 3. Partner Pharmacy Scheme. –The Partner Pharmacy Scheme, which is hereby incorporated in the Botika ng Bayan shall provide medicines and/ or medical supplies to Senior Citizens and Phihealth cardholders, especially the indigents & their beneficiaries admitted or confined at public and private hospitals, which shall thereafter be refunded and or discounted by PhilHealth to the Botika ng Bayan.
Section 4. Location of the Botika ng Bayan – For accessibility to the beneficiaries, the Botika ng Bayan shall be situated in the Bacolod City Health Office Compound.
Section 5. Operation/ Management/ Administration. – The operation, management & administration of the Botika ng Bayan shall be under the Socio-Economic Enterprise Unit of the City.
Section 6. OSCA’s Submission of Senior Citizens Maintenance Medicines to the Botika ng Bayan. – For regular medical supply of senior citizens in the City of Bacolod, the Office of the Senior Citizens Affairs(OSCA) is hereby mandated to submit bi-annually the maintenance medicines(and its brand) of senior citizens to the Botika ng Bayan.
Section 7. Initial Funds for the Botika ng Bayan which shall be considered as the City’s Socio-Economic Enterprise. – Funds necessary for the establishment of the Botika ng Bayan under the socio-economic enterprise shall come from the 20% development fund/ City annual budget which shall be used for the following:
a. Construction or renovation of a structure for the Botika ng Bayan,
b. Purchase of various medicines & supplies
c. Property, Plant and Equipment
d. Shelves, etc.
Section 8. Implementing Rules & Regulations(IRR). The City Health Department under the Office of the City Mayor shall come up with an Implementing Rules & Regulations(IRR) within Sixty (60) Days after the effectivity of this Ordinance, and submit the same to the Sangguniang Panlungsod for ratification.
Section 9. Separability Clause - If any provision of this Ordinance is held invalid, provisions which are not affected shall remain with full force and effect.
Section 10. Effectivity Clause. – This Ordinance shall take effect after Fifteen(15) Days after its publication in a newspaper of general circulation in the City of Bacolod.

AN ORDINANCE ESTABLISHING THE BOTIKA NG BAYAN UNDER THE SOCIO-ECONOMIC ENTERPRISE UNIT
WHEREAS, Section 15 of Article 2 of the 1987 Philippine Constitution provides that, “the State shall protect and promote the right to health of the people and instill health consciousness among them;”
WHEREAS, also the same Constitution, under Section 11 of Article XIII provides that, “the State shall adopt an integrated and comprehensive approach to health development, which shall endeavor to make essential goods, health and other social services available to all the people at affordable cost;”
WHEREAS, following the above-stated constitutional mandate, the City Government of Bacolod shall establish a health program which shall be known as the Botika ng Bayan,which shall be situated at the Bacolod City Health Office Compound, whose operation, management & administration shall also be held;
WHEREAS, for such purpose, and in order to efficiently deliver such medical services to the concerned needy, this Ordinance thru its Implementing Rules & Regulations(IRR) shall provide a system of refund and/or discount for Senior Citizens and Philhealth cardholders & their beneficiaries who are admitted or confined at the public or private hospitals under the “Partner Pharmacy Scheme;”
WHEREAS, thru the Botika ng Bayan, an effective & affordable medicines & other medical supplies would be available to the Senior Citizens and Philhealth cardholders, especially the indigents & their beneficiaries under the “Partner Pharmacy Scheme.”
WHEREAS, as provided in Section 16 of Republic Act No. 7160 otherwise known as, the Local Government Code of 1991, particularly under its “General Welfare Clause.,” which states that, “every local government unit shall exercise the powers expressly granted, those necessarily implied therefrom, as well as powers necessary, appropriate or incidental for its efficient and effective governance;”
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in session, that:
Section 1. Title. – The title of this Ordinance shall be known as, “An Ordinance Establishing the Botika ng Bayan under the Socio-Economic Enterprise Unit.”
Section 2. Establishment of the Botika ng Bayan. – The City of Bacolod thru this Ordinance, hereby establishes the Botika ng Bayan under the Socio-Economic Enterprise Unit to provide effective and affordable medicines and/ or medical supplies for Senior Citizens and Philhealth cardholders , especially the indigents & their beneficiaries who are admitted or confined at public and private hospitals.
Section 3. Partner Pharmacy Scheme. –The Partner Pharmacy Scheme, which is hereby incorporated in the Botika ng Bayan shall provide medicines and/ or medical supplies to Senior Citizens and Phihealth cardholders, especially the indigents & their beneficiaries admitted or confined at public and private hospitals, which shall thereafter be refunded and or discounted by PhilHealth to the Botika ng Bayan.
Section 4. Location of the Botika ng Bayan – For accessibility to the beneficiaries, the Botika ng Bayan shall be situated in the Bacolod City Health Office Compound.
Section 5. Operation/ Management/ Administration. – The operation, management & administration of the Botika ng Bayan shall be under the Socio-Economic Enterprise Unit of the City.
Section 6. OSCA’s Submission of Senior Citizens Maintenance Medicines to the Botika ng Bayan. – For regular medical supply of senior citizens in the City of Bacolod, the Office of the Senior Citizens Affairs(OSCA) is hereby mandated to submit bi-annually the maintenance medicines(and its brand) of senior citizens to the Botika ng Bayan.
Section 7. Initial Funds for the Botika ng Bayan which shall be considered as the City’s Socio-Economic Enterprise. – Funds necessary for the establishment of the Botika ng Bayan under the socio-economic enterprise shall come from the 20% development fund/ City annual budget which shall be used for the following:
a. Construction or renovation of a structure for the Botika ng Bayan,
b. Purchase of various medicines & supplies
c. Property, Plant and Equipment
d. Shelves, etc.
Section 8. Implementing Rules & Regulations(IRR). The City Health Department under the Office of the City Mayor shall come up with an Implementing Rules & Regulations(IRR) within Sixty (60) Days after the effectivity of this Ordinance, and submit the same to the Sangguniang Panlungsod for ratification.
Section 9. Separability Clause - If any provision of this Ordinance is held invalid, provisions which are not affected shall remain with full force and effect.
Section 10. Effectivity Clause. – This Ordinance shall take effect after Fifteen(15) Days after its publication in a newspaper of general circulation in the City of Bacolod.

WHEREAS, Article 16 or the General Welfare Clause of Republic Act 7160 (the Local Government Code of 1991) mandates all LGUs to implement programs beneficial to its citizens;
WHEREAS, numerous national laws; Presidential Decrees; Executive Orders; Proclamations, Memorandum Circulars, local Executive Orders, Ordinances and Resolutions for programs and services have been passed for poor and homeless citizens & informal settlers;
WHEREAS, there is a need for the City to come up with a comprehensive sustainable development program for shelter services & poverty alleviation to respond and protect the basic rights of poor and homeless citizens & informal settlers against eviction and demolition as well as their transfer to relocation sites;
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in session assembled, that:

Be it ordained by the Sangguniang Panlungsod of Bacolod, that:
Section 1 – The deadline of One Stop Shop Program of the City for the payment of business taxes and incidental fees without penalties is hereby extended from February 15, 2012 to February 29, 2012 under the Revised Revenue Code of 2011, per letter-request of the Honorable City Mayor Evelio R. Leonardia dated February 13, 2012 and docketed as SP Correspondence No. 012-36-B without prejudice for further extension until March 30, 2012 as the need arises.
Section 2 – This ordinance shall take effect upon its approval.

AN ORDINANCE INSTITUTIONALIZING THE PROGRAMS & SERVICES TO SOLO PARENTS AND THEIR CHILDREN, PROVIDING FUNDS THEREFOR, & FOR OTHER PURPOSES.
WHEREAS, the adverse effects of the economic crises continued to burden the people, especially the unemployed and under-employed poor people in the City of Bacolod, but those who suffered most are the solo parents & their children;
WHEREAS, solo parents are individuals who due to unfavorable circumstances are left alone to rear, provide and support the needs of their children, which, among others, include provision for food, education, clothing, shelter & other basic necessities for their daily survival;
WHEREAS, in that situation, solo parents with parenthood responsibility are given assistance and support by the government pursuant to Republic Act # 8972, otherwise known as “The Solo Parents Welfare Act of 2000;”
WHEREAS, premises considered, there is a need for the City of Bacolod to enact an ordinance which will institutionalize appropriate programs and services for solo parents & their children in the City of Bacolod;
THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod, in session, assembled, that:
Section 1. Title of the Ordinance- The title of this ordinance shall be called as “An Ordinance Institutionalizing the Programs & Services to Solo Parents and their Children, Providing Funds Therefor, & for Other Purposes.” Its short title shall be known as “The Solo Parents Programs/Services Ordinance.”
Section 2. Definition of Terms – The following terms, to mean as follow:
1) Solo Parent – per Republic Act 8972, refers to any individual who falls under any of the following categories:
a) A woman who gives birth as a result of rape and other crimes against chastity even without a final conviction of the offender. Provided that the mother keeps and raises the child.
b) Parent left solo or alone with the responsibility of parenthood due to the death of spouse.

c) Parent left solo or alone with the responsibility of parenthood while the spouse is detained or is serving sentence for a criminal conviction for at least one (1) year.
d) Parent left solo or alone with the responsibility of parenthood due to physical and/or mental incapacity of spouse as certified by a public medical practitioner.
e) Parent left solo or alone due to legal separation or de facto separation from spouse for at least one (1) year as long as he or she is entrusted with the custody of the children.
f) Parent left solo or alone due to declaration of nullity or annulment of marriage as decreed by a court or by a church as long as he/she is entrusted with the custody of children.
g) Parent left solo or alone with the responsibility of parenthood due to abandonment of spouse for at least one(1) year.
h) Unmarried father/mother who has preferred to keep and rear his/her child/children instead of having others care for them or give them up to the welfare institution.
i) Any other person who solely provide parental care and support to a child or children.
j) Any family member who assumes the responsibility of head of the family as a result of the death, abandonment, disappearance or prolonged absence of the parents or solo parent.
A change in the status or circumstance of the parent claiming benefits under this Act , such that he/she is no longer left alone with the responsibility of parenthood shall terminate his/her eligibility for these benefits.
2) Children – refer to those living with and dependent upon the solo parent for support who are unmarried, unemployed and not more than eighteen years (18) years of age or even above 18 years but are incapable of self support because of mental and/ or physical defect or disability.
3) Parental leave – as defined by RA 8972, refers to leave benefits granted to a solo parent to enable him/her to perform parental duties and responsibilities where physical presence is required.
4) Flexible work schedule – refers to the right granted to a solo parent employee or worker to vary his/her arrival and departure time without affecting the core work hours as defined by the employer (RA 8972).

5) SEA-K - refers to Self Employment Assistance-Kaunlaran
6) SEED - refers to Self Employment and Entrepreneurship Development.
7) ALS - refers to the Alternative Learning System
8) DOLE - refers to the Department of Labor & Employment
9) NSCB - refers to the National Statistical Coordination Board, which attached to NEDA, and responsible for determining the regional poverty threshold.
10) NEDA - refers to National Economic Development Authority
11) Republic Act 8972 – refers to an Act Providing for the Benefits and Privileges to Solo Parents and their Children, Appropriating Funds Therefor, and for Other Purposes.
12) TESDA – refers to Technical Education and Skills Development Authority.
Section 3 Requirements to Avail of Programs and Services:
a. Certificate of Residency from the barangay concerned that applicant is a barangay resident of such barangay in the City of Bacolodfor at least six (6) months.
b. Comelec ID (Identification Card) or Registration
c. Proof and/or documents of being a solo parent.
d. Barangay Certification or Affidavit as to the income of the applicant, showing that his/her income falls equal or below the poverty threshold as set by National Statistical Coordination Board (NSCB), per section 7 of the IRR of RA 8972.
(The latest, 2007 monthly poverty threshold of the Province of Negros Occidental which Bacolod City is included, per attached reference is Php 13,972.00).
Section 4. Issuance of Solo Parent’s ID – In issuing for the solo parent’s ID, for purposes of availment of an appropriate services from agencies concerned, the DSSD or its authorized personnel shall see to it that the following information shall be reflected at the back of such ID.
a. An information, that a solo parent is “An Indigent,” if a bearer of such solo parent ID is an indigent.

b. An information, that the solo parent’s “income falls or below monthly poverty threshold,” if a bearer of such solo parent ID’s income falls or below monthly poverty threshold(The latest 2006 monthly poverty threshold is Php 13,972.00.)
c. An information, that the solo parent’s “income is above monthly poverty threshold,” if the bearer of such solo parent’s ID belongs to such category.
d. Solo parent’s ID issued by the DSSD, which is signed by the DSSD Head him/herself and the City Mayor upon payment of Php 100.00 to the City Treasurer’s Office.
On the said ID, the names of solo parent’s dependents with their corresponding age shall also be stated therein.
Section 5. Programs and Services to Solo Parents -The following are the services that shall be extended to the solo parent indigents and to those who fall below poverty threshold:
a. Livelihood assistance and skills training or capacity building from the City thru the City Cooperative & Development Office(CCLDO).
b. TESDA Livelihood and Skills development Programs
c. DOLE Program on Self Employment and Entrepreneurship Development(SEED)
d. DSSD assistance or thru SEA-K or Self Empowerment Assistance-Kaunlaran
Section 6. Employment Related Benefits to the Solo Parent
a. Aside from the benefits he/she enjoyed, Solo parent employee/worker who has rendered at least one (1) year of service to the city government or private company/entity (whether continuous or broken) shall be granted seven (7) days parental leave every year. To facilitate the hereto benefit granted, with the presentation of Solo Parent’s ID issued by the DSSD, solo parent shall notify the employer for such availment.
b. Flexible work schedule shall be given to the solo parents by the City inthe case of public employees, and by the management in the case of private business, as the case may be.
However, in the case of the City government, such flexible work schedule, upon proper evaluation shall be subject to the discretion of the department head.

And, in the case of private business, the work schedule shall not affect company’s productivity. And, any employer may request an exemption of such requirements from the DOLE on meritorious ground.
c. Solo parents shall be protected against work discrimination in their work station.
Section 7. Housing Benefits. –Solo parents who meet the qualification under the Republic Act 7279 shall be given housing assistance by the Bacolod Housing Authority Office (BHA). Furthermore, indigent, poor and homeless solo parent must be given priority in the City’s relocation site.
Section 8. Psycho-Social Services for all Solo Parents as Intervention, under Republic Act # 8972, and hereof adopted under this Ordinance, including the following:
a. Individual counseling from appropriate government agency
b. Peer group counseling
c. Family counseling
d. Organization of Solo Parents Club or Associations
e. Accessing referrals from support services: like education, health, medical, burial, etc.
Section 9. Education services thru the following agencies (RA 8972):
DEP-ED – Non-formal appropriate education program, e.g. Alternative Learning System or ALS.
TESDA – Technical and/ or vocational education
– Private Education Student Finance Assistance (PESFA), thru R. A. 8972
CHED - Scholarship program for qualified solo parent and their children in basic
tertiary and technical education
– Study grant
Applicant Procedure:
1. Applicant must secure application form from either DepEd, CHED and TESDA, depending on their need.

2. Submit the duly accomplished application form, together with the required documents to the appropriate agency.
The following are the required documents to be attached with the application to either DepEd, CHED and TESDA:
1) Solo parent ID Card
2) Barangay Clearance
3) Birth Certificate
4) Notice of Admission from the School
5) Report Card of last year the applicant attended school or Original or certified true copy of Transcript of Records
Section 10. Health Services – In addition to the health benefits under RA 8972, indigent solo parents shall enjoy free laboratory fees, free X-ray and free tooth extraction, upon presentation of Solo Parents ID.
Section 11. Implementing Rules and Regulations(IRR). – A Committee under this Ordinance shall be created to come up the Implementing Rules & Regulations within Sixty (60) Days upon the passage of this Ordinance, which shall be submitted to the Sangguniang Panlungsod for ratification. This committee shall compose the following offices which will be represented by its respective heads.
1. Department of Social Services & Development(DSSD)- Convenor and lead office
2. City Health Office(CHO)
3. City Cooperative and Livelihood Office(CCLDO)
4. Department of Interior & Local Government(DILG) – Bacolod Office
5. Commission on Higher Education(CHEd) – Bacolod
6. Technical Education and Skills Development Authority(TESDA) – Negros Occidental
7. Department of Labor & Eployment(DOLE) – Bacolod
8. DOH-Western Visayas Regional Hospital, Lacson St., Bacolod City

Section 12. Funding - For an effective implementation of this Ordinance, a certain budget from GAD budget shall be yearly allocated.
Section 13. Separability Clause – If any provision of this Ordinance is held invalid, other provisions not affected thereby shall continue to be in full force and effect.
Section 14. Effectivity Clause –This Ordinance shall take effect Fifteen (15) Days after its publication in a newspaper of general circulation in the City of Bacolod.

AN ORDINANCE INSTITUTIONALIZING THE PROGRAMS & SERVICES TO SOLO PARENTS AND THEIR CHILDREN, PROVIDING FUNDS THEREFOR, & FOR OTHER PURPOSES.
WHEREAS, the adverse effects of the economic crises continued to burden the people, especially the unemployed and under-employed poor people in the City of Bacolod, but those who suffered most are the solo parents & their children;
WHEREAS, solo parents are individuals who due to unfavorable circumstances are left alone to rear, provide and support the needs of their children, which, among others, include provision for food, education, clothing, shelter & other basic necessities for their daily survival;
WHEREAS, in that situation, solo parents with parenthood responsibility are given assistance and support by the government pursuant to Republic Act # 8972, otherwise known as “The Solo Parents Welfare Act of 2000;”
WHEREAS, premises considered, there is a need for the City of Bacolod to enact an ordinance which will institutionalize appropriate programs and services for solo parents & their children in the City of Bacolod;
THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod, in session, assembled, that:
Section 1. Title of the Ordinance- The title of this ordinance shall be called as “An Ordinance Institutionalizing the Programs & Services to Solo Parents and their Children, Providing Funds Therefor, & for Other Purposes.” Its short title shall be known as “The Solo Parents Programs/Services Ordinance.”
Section 2. Definition of Terms – The following terms, to mean as follow:
1) Solo Parent – per Republic Act 8972, refers to any individual who falls under any of the following categories:
a) A woman who gives birth as a result of rape and other crimes against chastity even without a final conviction of the offender. Provided that the mother keeps and raises the child.
b) Parent left solo or alone with the responsibility of parenthood due to the death of spouse.

c) Parent left solo or alone with the responsibility of parenthood while the spouse is detained or is serving sentence for a criminal conviction for at least one (1) year.
d) Parent left solo or alone with the responsibility of parenthood due to physical and/or mental incapacity of spouse as certified by a public medical practitioner.
e) Parent left solo or alone due to legal separation or de facto separation from spouse for at least one (1) year as long as he or she is entrusted with the custody of the children.
f) Parent left solo or alone due to declaration of nullity or annulment of marriage as decreed by a court or by a church as long as he/she is entrusted with the custody of children.
g) Parent left solo or alone with the responsibility of parenthood due to abandonment of spouse for at least one(1) year.
h) Unmarried father/mother who has preferred to keep and rear his/her child/children instead of having others care for them or give them up to the welfare institution.
i) Any other person who solely provide parental care and support to a child or children.
j) Any family member who assumes the responsibility of head of the family as a result of the death, abandonment, disappearance or prolonged absence of the parents or solo parent.
A change in the status or circumstance of the parent claiming benefits under this Act , such that he/she is no longer left alone with the responsibility of parenthood shall terminate his/her eligibility for these benefits.
2) Children – refer to those living with and dependent upon the solo parent for support who are unmarried, unemployed and not more than eighteen years (18) years of age or even above 18 years but are incapable of self support because of mental and/ or physical defect or disability.
3) Parental leave – as defined by RA 8972, refers to leave benefits granted to a solo parent to enable him/her to perform parental duties and responsibilities where physical presence is required.
4) Flexible work schedule – refers to the right granted to a solo parent employee or worker to vary his/her arrival and departure time without affecting the core work hours as defined by the employer (RA 8972).

5) SEA-K - refers to Self Employment Assistance-Kaunlaran
6) SEED - refers to Self Employment and Entrepreneurship Development.
7) ALS - refers to the Alternative Learning System
8) DOLE - refers to the Department of Labor & Employment
9) NSCB - refers to the National Statistical Coordination Board, which attached to NEDA, and responsible for determining the regional poverty threshold.
10) NEDA - refers to National Economic Development Authority
11) Republic Act 8972 – refers to an Act Providing for the Benefits and Privileges to Solo Parents and their Children, Appropriating Funds Therefor, and for Other Purposes.
12) TESDA – refers to Technical Education and Skills Development Authority.
Section 3 Requirements to Avail of Programs and Services:
a. Certificate of Residency from the barangay concerned that applicant is a barangay resident of such barangay in the City of Bacolodfor at least six (6) months.
b. Comelec ID (Identification Card) or Registration
c. Proof and/or documents of being a solo parent.
d. Barangay Certification or Affidavit as to the income of the applicant, showing that his/her income falls equal or below the poverty threshold as set by National Statistical Coordination Board (NSCB), per section 7 of the IRR of RA 8972.
(The latest, 2007 monthly poverty threshold of the Province of Negros Occidental which Bacolod City is included, per attached reference is Php 13,972.00).
Section 4. Issuance of Solo Parent’s ID – In issuing for the solo parent’s ID, for purposes of availment of an appropriate services from agencies concerned, the DSSD or its authorized personnel shall see to it that the following information shall be reflected at the back of such ID.
a. An information, that a solo parent is “An Indigent,” if a bearer of such solo parent ID is an indigent.

b. An information, that the solo parent’s “income falls or below monthly poverty threshold,” if a bearer of such solo parent ID’s income falls or below monthly poverty threshold(The latest 2006 monthly poverty threshold is Php 13,972.00.)
c. An information, that the solo parent’s “income is above monthly poverty threshold,” if the bearer of such solo parent’s ID belongs to such category.
d. Solo parent’s ID issued by the DSSD, which is signed by the DSSD Head him/herself and the City Mayor upon payment of Php 100.00 to the City Treasurer’s Office.
On the said ID, the names of solo parent’s dependents with their corresponding age shall also be stated therein.
Section 5. Programs and Services to Solo Parents -The following are the services that shall be extended to the solo parent indigents and to those who fall below poverty threshold:
a. Livelihood assistance and skills training or capacity building from the City thru the City Cooperative & Development Office(CCLDO).
b. TESDA Livelihood and Skills development Programs
c. DOLE Program on Self Employment and Entrepreneurship Development(SEED)
d. DSSD assistance or thru SEA-K or Self Empowerment Assistance-Kaunlaran
Section 6. Employment Related Benefits to the Solo Parent
a. Aside from the benefits he/she enjoyed, Solo parent employee/worker who has rendered at least one (1) year of service to the city government or private company/entity (whether continuous or broken) shall be granted seven (7) days parental leave every year. To facilitate the hereto benefit granted, with the presentation of Solo Parent’s ID issued by the DSSD, solo parent shall notify the employer for such availment.
b. Flexible work schedule shall be given to the solo parents by the City inthe case of public employees, and by the management in the case of private business, as the case may be.
However, in the case of the City government, such flexible work schedule, upon proper evaluation shall be subject to the discretion of the department head.

And, in the case of private business, the work schedule shall not affect company’s productivity. And, any employer may request an exemption of such requirements from the DOLE on meritorious ground.
c. Solo parents shall be protected against work discrimination in their work station.
Section 7. Housing Benefits. –Solo parents who meet the qualification under the Republic Act 7279 shall be given housing assistance by the Bacolod Housing Authority Office (BHA). Furthermore, indigent, poor and homeless solo parent must be given priority in the City’s relocation site.
Section 8. Psycho-Social Services for all Solo Parents as Intervention, under Republic Act # 8972, and hereof adopted under this Ordinance, including the following:
a. Individual counseling from appropriate government agency
b. Peer group counseling
c. Family counseling
d. Organization of Solo Parents Club or Associations
e. Accessing referrals from support services: like education, health, medical, burial, etc.
Section 9. Education services thru the following agencies (RA 8972):
DEP-ED – Non-formal appropriate education program, e.g. Alternative Learning System or ALS.
TESDA – Technical and/ or vocational education
– Private Education Student Finance Assistance (PESFA), thru R. A. 8972
CHED - Scholarship program for qualified solo parent and their children in basic
tertiary and technical education
– Study grant
Applicant Procedure:
1. Applicant must secure application form from either DepEd, CHED and TESDA, depending on their need.

2. Submit the duly accomplished application form, together with the required documents to the appropriate agency.
The following are the required documents to be attached with the application to either DepEd, CHED and TESDA:
1) Solo parent ID Card
2) Barangay Clearance
3) Birth Certificate
4) Notice of Admission from the School
5) Report Card of last year the applicant attended school or Original or certified true copy of Transcript of Records
Section 10. Health Services – In addition to the health benefits under RA 8972, indigent solo parents shall enjoy free laboratory fees, free X-ray and free tooth extraction, upon presentation of Solo Parents ID.
Section 11. Implementing Rules and Regulations(IRR). – A Committee under this Ordinance shall be created to come up the Implementing Rules & Regulations within Sixty (60) Days upon the passage of this Ordinance, which shall be submitted to the Sangguniang Panlungsod for ratification. This committee shall compose the following offices which will be represented by its respective heads.
1. Department of Social Services & Development(DSSD)- Convenor and lead office
2. City Health Office(CHO)
3. City Cooperative and Livelihood Office(CCLDO)
4. Department of Interior & Local Government(DILG) – Bacolod Office
5. Commission on Higher Education(CHEd) – Bacolod
6. Technical Education and Skills Development Authority(TESDA) – Negros Occidental
7. Department of Labor & Eployment(DOLE) – Bacolod
8. DOH-Western Visayas Regional Hospital, Lacson St., Bacolod City

Section 12. Funding - For an effective implementation of this Ordinance, a certain budget from GAD budget shall be yearly allocated.
Section 13. Separability Clause – If any provision of this Ordinance is held invalid, other provisions not affected thereby shall continue to be in full force and effect.
Section 14. Effectivity Clause –This Ordinance shall take effect Fifteen (15) Days after its publication in a newspaper of general circulation in the City of Bacolod.

AN ORDINANCE PROHIBITING THE USE OF CELLULAR TELEPHONES, OPERATION OF LOAD CENTERS AND/OR ANY BUSINESS OF SIMILAR NATURE WITHIN THE PREMISESOF GASOLINE/ FUEL STATIONS OR DEPOTS IN THE CITY OF BACOLOD, PROVIDING PENALTY FOR VIOLATION THEREOF, AND FOR OTHER PURPOSES
WHEREAS, the Local Government Code of 1991, otherwise known as, Republic Act #7160, mandates all Local Government Units(LGUs) to promote the interest & public welfare of the people and protect & preserve the safety of their constituents;
WHEREAS, taking cognizance of the Welfare Clause provision of the Local Government Code, the Sangguniang Panlungsod of the City of Bacolod recognizes that using cellular telephones within the premises of gasoline stations(especially when such vehicles are on the state of refilling fuel) or depotspose hazard to the safety of the motorists, gasoline station employees, nearby establishments and even passers-by due to possible ignition of highly flammable fumes & materials that may be carried by the cellular phones;
WHEREAS, the possibility of such danger is acknowledged not only by the public itself, but also by cellular telephone manufacturers, as evidenced by the warnings thereon stated in their products, as well asby petroleum companies here & abroad as reflected in their notices & information materials, andby other local government units and national government agencies in our country;
WHEREAS, based on the above information,there is a need for the City of Bacolod to take precautionary steps thru a pertinent policy measure passed by the Sangguniang Panlungsod in order to avoid any possible accident or incident which may occur because of improper use of cellular telephones within the premises of the gasoline stations;
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in session, that:
Section 1. Title – This ordinance shall be known as, “An Ordinance Prohibiting the Use of Cellular Telephones, Operation of Load Centers and/or any Business of Similar Nature Within the Premises of Gasoline/fuel Stations or depotsin the City of Bacolod, Providing Penalty for Violation Thereof, and for Other Purposes.”

Section 2. Provision of Signages – Gasoline/fuel station or depot owners/ operators are hereby required to post prominent signages in their establishments informing their clientele in particular; and the public in general of this Ordinance, and also, mandated to direct their attendants & employees to remind their customers and the public to switch-off their cellular telephones while they are in the process of refilling fuel or gasoline for their vehicles.
For the stated purpose, WITHIN NINETY (90) DAYS, following the effectivity of this Ordinance, owners/operators of existing gasoline/fuel stations or depots are mandated to provide such required signages.
As requisite for the ISSUANCE of the Mayor’s permit of the stated businesses, the Permits & Licensing Division is hereby mandated to ensure the compliance of the provision hereof.
Section 3. Prohibitions - The following are considered prohibited acts under this Ordinance:
3.1 The use of cellular phones within the premises of gasoline station/fuel or depot in the City of Bacolod is hereby prohibited
3.2 Operations of Electronic load or E-load centers or similar businesses within the premises of the above stated businesses are likewise prohibited.
Selling of cell cards within the stated business premises, however, is not covered under this provision.
Section 4. Fines or Penalty:
a. Any person found to violate paragraph 3.1 of Section 3 hereof shall be fined Five Hundred (Php 500.00) Pesos.
b. The following constitute violation of paragraph 3.2 of Section 3 hereof:
1) 1st Offense - A fine of One Thousand (1,000.00) Pesos.
2) 2nd Offense - A fine of Three Thousand (3,000.00) Pesos
3) 3rd Offense - A fine of Five Thousand (5,000.00) Pesos
And, revocation of business permits that operate in such prohibited premises.

AN ORDINANCE ESTABLISHING DOG-OWNERS RESPONSIBILITY, REQUIRING ENCLOSURES OR FENCED-IN YARD FOR PET DOGS AS PREVENTIVE MEASURE AGAINST OCCURRENCE OF RABIES INJURY, DAMAGE & OTHER HAZARDS
WHEREAS, rabies is an infectious & viral disease considered threatening to health of the populace;
WHEREAS, despite national & local programs to eradicate rabies the same remains among the major menace to health;
WHEREAS, the health problembrought by rabies is seen in a number of patients seeking an anti-rabies vaccine;
WHEREAS, there is a need for the City to come up preventive measures against rabies infection;
WHEREAS, to address the danger/threat caused by rabies and other possible injuries or damage posed to the public, there is a need for the Sangguniang Panlungsod to pass an enabling law involving dog-owners;
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in session, that:
Section 1. Title –This Ordinance shall be known as Dog-Owners Responsibility Ordinance.
Section 2. Definition of Terms.
1) DOG-OWNERS - refer to any person keeping, harboring or having charge, care or control of dogs, including his/her representative.

2) RABIES - refers to a highly fatal disease caused by a lyssa virus, transmitted mainly thru the bite of an infected animal and is characterized by muscle paralysis, hydrophobia and earophobia, and other neurological manifestations.

Section 3. Policy.
a) The City of Bacolod recognizes that dogs are among a person’s personal properties.
b) No barangay in the City of Bacolod shall restrict or prohibit anyone to own a dog, provided that he or she shall provide enclosures or fenced-in yard for said dogs, and shall be responsible for its upkeep and maintenance;
C) The City of Bacolod recognizes the right of the people to own a dog of whatever breed allowed under our laws.
Section 4. Responsibilities of Dog Owners. Aside from section 5 of Republic Act 9482, the following are also the responsibilities of dog-owners in the City of Bacolod
a) All dogs shall be securely contained within the owner’s premises/property, without cruel restraint by tying.
b) All dogs shall be securely leashed whenever taken out of the owner’s premises, and, under the supervision of a person who is physically capable of controlling the dog.
c) Parents who allow their child to lead a dog in public places, open spaces or parks, alleys or streets/ roads shall assume the liability for any trespass, accident, harm or injury caused by their dog.

d) Dog-owners shall, upon demand by authorized persons, produce the immunization records of their dogs found at large as may be required by the Veterinary Office of Bacolod City.
e) Owners shall take all reasonable steps to ensure that their dog do not injure, harm, endanger, intimidate or cause distress to any person & other animals nor damage or endanger any property belonging to any other person.
f) Confine dog to owner’s property and preventing it from roaming or wandering around unattended.
g) Get an official permit and /or tag from the City Veterinary Office or any authorized agency.
h) Remove dog feces or wastes left in public places or open spaces.
i) Secure the dog by properly tying it when it is carried on board avehicle.
j) Dog-owners shall insure that dogs are given the needed immunizations and/or vaccines to prevent spread of rabies and/or similar infections.
k) Have their dogs registered in the City Veterinary Office.
l) Assist dog bitten victim immediately, and shoulder medical expenses incurred & other incidental expenses relative to the victim’s injury.
Section 5. Commercial Dog Breeders. – Commercial dog breeders shall secure business license from the City for their business operation. However, operation of the same shall be banned in residential or populous areas.
Section 6. Fines/ Penalty – Violation of Section 4 hereof shall be fined based on the following:
1st offense - Fine of Php 500.00.
2nd offense - Fine of Php 1,000.00
3rd offense - Fine of Php 2,000.00

And, dogs shall be placed at the dog pound in the City Veterinary Office for adoption. Otherwise, it shall be exterminated humanely.
Section 7. Registration of Dogs. – Dog-owners shall register their pet dogs to the City Veterinary Office, upon payment of Fifty Pesos (Php 50.00as Registration Fee) to the City Treasurer’s Office. Pursuant thereto, section 10 of the City Ordinance 184, series of 1997(An Ordinance Approving the Rabies Eradication, Prevention and Control Program of Bacolod City) shall be amended or modified accordingly.
Section 8. Implementing Rules & Regulations(IRR).–A Committee be constituted within Sixty (60) Days from its passage, composed of the following:
1) City Mayor or his/her designated representative,
2) City Health Office,
3) City Veterinary Office,
4) City Agriculture Office, and
5) Chairman of the SP Committee on Health
The Committee shall come up with Implementing Rules & Regulations (IRR), and submit the same to the Sangguniang Panlungsod within forty five (45) days after its passage for ratification.
Section 9. Repealing Clause. - All ordinances that are inconsistent with the provisions of this Ordinance are hereby repealed, amended or modified accordingly.
Section 10. Separability Clause. - If any provision of this ordinance be declared invalid, other provisions which are not so declared shall remain valid and shall be in fullforce and effect.
Section 11. Effectivity Clause – This ordinance shall take effect after fifteen (15) days after its publication in a newspaper of general circulation in the City of Bacolod.

AN ORDINANCE ESTABLISHING DOG-OWNERS RESPONSIBILITY, REQUIRING ENCLOSURES OR FENCED-IN YARD FOR PET DOGS AS PREVENTIVE MEASURE AGAINST OCCURRENCE OF RABIES INJURY, DAMAGE & OTHER HAZARDS
WHEREAS, rabies is an infectious & viral disease considered threatening to health of the populace;
WHEREAS, despite national & local programs to eradicate rabies the same remains among the major menace to health;
WHEREAS, the health problembrought by rabies is seen in a number of patients seeking an anti-rabies vaccine;
WHEREAS, there is a need for the City to come up preventive measures against rabies infection;
WHEREAS, to address the danger/threat caused by rabies and other possible injuries or damage posed to the public, there is a need for the Sangguniang Panlungsod to pass an enabling law involving dog-owners;
NOW THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in session, that:
Section 1. Title –This Ordinance shall be known as Dog-Owners Responsibility Ordinance.
Section 2. Definition of Terms.
1) DOG-OWNERS - refer to any person keeping, harboring or having charge, care or control of dogs, including his/her representative.

2) RABIES - refers to a highly fatal disease caused by a lyssa virus, transmitted mainly thru the bite of an infected animal and is characterized by muscle paralysis, hydrophobia and earophobia, and other neurological manifestations.

AN ORDINANCE FORTIFYING THE IMPLEMENTATION OF SECTION 393, PARAGRAPH (b)(4) AND SECTION 434, PARAGRAPH (1)OF THE LOCAL GOVERNMENT CODE OF 1991 & ARTICLE 203 OF ITS IMPLEMENTING RULES & REGULATIONS, RESPECTIVELY, GRANTING SCHOLARSHIP PRIVILEGE FOR THE LEGITIMATE DEPENDENTS OF THE PUNONG BARANGAY, SANGGUNIANG BARANGAY MEMBERS, BARANGAY TREASURER, BARANGAY SECRETARY & SANGGUNIANG KABATAAN OFFICIALS OF THE CITY THRU THE BACOLOD CITY COLLEGE & OTHER CITY COLLEGES OR UNIVERSITIES THAT MAY HENCEFORTH BE ESTABLISHED.
WHEREAS, Local Government Code of 1991, section 393, paragraph (b)(4), states that, “The Punong barangay, the sangguniang barangay members, the barangay treasurer, and the barangay secretary shall also: Be exempted during their incumbency from paying tuition and matriculation fees for their legitimate children attending state colleges or universities. He may likewise avail of such educational benefits in a state college or university located within the province or city to which the barangay belong;”
WHEREAS, also, section 434 of the same Code, and repeatedly spelled out in Article 203, paragraph (1), of its Implementing Rules & Regulations states that, and to quote, “During their incumbency, Sangguniang Kabataan Officials shall be exempt from payment of tuition and matriculation fees while enrolled in public tertiary schools, including state colleges and universities. The national government shall reimburse said college and university the amount of the tuition and matriculation fees provided that to qualify for the privilege, said officials shall enroll in the state college or university within or nearest their area of jurisdiction.”
WHEREAS, while such privileges thru the Local Government Code is extended to SK officials thru state colleges & universities, under this ordinance, similar scholarship privilege shall also be extended by the City to legitimate dependents of Punong Barangays, Sangguniang Barangay Members, Barangay Treasurers & Barangay Secretaries thru the Bacolod City College, as a public tertiary school based in the CITY, following the intent and purposes of the Local Government Code of 1991, and Its Implementing Rules & Regulations, and its processes in availing such privilege, which mandates to benefit legitimate children of elected & appointed barangay and sangguniang kabataan officials concerned, while they serve their incumbency in office;
WHEREAS, such granting of scholarship privilege which is clearly stipulated in our basic law, however, was not appropriately given due cognizance for years by the City supposed to be thru the Bacolod City College, which if fully implemented will benefit a number of our under-privileged youth and students, give them a chance to realize their dream for higher learning, and pave their way to a better future;

This ordinance shall cover all legitimate dependents of the punong barangays, sangguniang barangay members, barangay treasurers & barangay secretaries, and the sangguniang kabataan officials of the City of Bacolod.
Section 3. Implementing Rules & Regulations – The Bacolod City College is mandated to formulate the Implementing Rules & Regulations(IRR) of this Ordinance, and submit to the Sangguniang Panlungsod within SIXTY (60) Days after approval hereof.

AN ORDINANCE ALLOWING FOR THE TRANSFER OF AWARDS TO THE PRESENT MARKET BLOCK/STALL/TABLE OCCUPANTS.
WHEREAS, the provisions of the “CONTRACT OF LEASE” under City Ordinance # 160, series of 1996 or the Market Code of Bacolod City prohibit the transfer of awards or sub-leasing of blocks/ stalls/ tables, except in the case of death or legal incapacity of the awardee, in which case, the award maybe transferred to the surviving spouse, son or daughter or a business partner;
WHEREAS, approval by the Local Market Committee on application for transfers which were actually done in previous years have served as precedents to give the interested persons an impression that despite of clear provisions in the Market Code, transfer maybe made to an alleged business partners for causes other than death or legal disability;
WHEREAS, having taken cognizance on the actual conditions of the public markets, including Manokan Country, also revealed that a number of blocks/ stalls/tables therein have been since then operated by illegal transferees or subleases, and not by (original) awardees;
WHEREAS, the procedure prescribed by the Market Code of 1996 for these violations is an outright revocation of award, and re-raffle of the same for the vacant block/stall/ table. However, this procedure will displace not only the awardees who violated the Market Code, but will also cause eviction of the present occupants, who, being disadvantaged by their not being awardees paid or are paying sizable amounts to be able to earn a living from business conducted in our public markets;
WHEREAS, based on the stated information and circumstances, there is a need to rectify the present situation in our public markets, straighten out the record of market lessees, and put a stop to the illegal transferring and sub-leasing of market block/stall or table;
THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in session, that:

Section 1. Title of the Ordinance. The title of this ordinance shall be known as, “An Ordinance Allowing for the Transfer of Awards to the Present Market Block/Stall/Table Occupants.”
Section 2. Application for Cancellation of Original Award and Subsequent Issuance of New Award.
Within Ninety(90) Days from the passage of this ordinance, all non-awardees who are presently doing business in the blocks/stalls/ tables/ booths or kiosks in the City’s North Burgos, South Libertad and Central Markets, including Manokan Country may apply for cancellation of the original award, and the issuance of new award to them, without need for a declaration of block/stall/table/ booth or kiosks vacancy, and the raffle mandated under section 18 of the Market Code of 1996. The issuance of new awards to the present market occupants, however shall be subject to the following terms and conditions:
1. Cancellation of the original awards and issuance of new awards under this ordinance shall be made in accordance with the procedure as prescribed by the Local Market Committee.
2. Within Sixty (60) Days after receipt of notice of approval by the Local Market Committee, the prospective awardee shall pay the following fees:
Transfer Fee:
a. EXTERIOR BLOCK/STALL – Twenty Thousand Pesos (Php 20,000.00)
b. INTERIOR BLOCK/STALL - Fifteen Thousand Pesos (Php 15,000.00)
c. MEAT TABLE - Ten Thousand Pesos (Php 10,000.00)
d. FISH TABLE - Seven Thousand Pesos (Php 7,000.00)
e. VEGETABLE TABLE - Four Thousand Pesos (Php 4,000.00)
Furthermore, the present occupants shall also pay all delinquencies for rental and business permits pertaining to the said block/stall/table/booth or kiosk. However, the Local Market Committee may also allow payment of rental arrearages thru installment in meritorious cases only, and, not to exceed One (1)-Year period for payment. The new award shall be issued, and, a lease contract executed only after all fees and arrearages have been paid.

Failure to update the rentals and business permit fees by the end of One (1)Year period after approval of the application shall be a ground for cancellation of the award, and declaration of the vacancy of the block/stall/table/booth or kiosk.
Section 3. The applicant to whom the award is issued must be the exclusive owner of the business, and he/she must occupy, administer, and be present personally at his/her block/stall/table/booth or kiosk to conduct the business thereof, in accordance with section 19 of the Market Code of 1996.
An applicant, however, may seek an exemption from the prohibition in the Market Code of 1996, by duly designating his/her caretakers or hired personnel
Section 4. Pending approval of new rates for market rentals, the new awardees shall pay rentals at the current rate. The lease contracts to be executed by the new awardees and the City block/stall/table/booth/kiosk, however, include a proviso that they (new awardees) shall be subject to such rate increase as the Sanggunian may enact for the market blocks/stalls/tables, booths or kiosks.
Section 5. Awards that are revoked by virtue of this Ordinance are deemed revoked for causes provided under the Market Code of 1996, particularly, the provisions against transfers and sub-leasing of awards. As such, holders of the revoked award shall, thereafter, be disqualified from applying for any other block, stall/table/booth or kiosk in any public market (including Manokan Country) of the City.
Section 6. The suspension of section 18 of the Market Code of 1996 shall be valid only for applications which are duly received by the Market Committee within Ninety (90) Days from the effectivity of this Ordinance.
For Transferees:
All Transferees who have not applied for transfer of the award to them shall file an application under Oath in a form to be prescribed by the Local Market Committee, stating therein their names and legal circumstances, the name of the original awardee, the Number and Section of the block/stall and the market where it is found, the date the applicant began doing business in said block/stall, the nature of his/her business, the amount paid to the awardee for the transfer or the waive of rights.
Also, attached to the application shall be the Articles of Partnership, Waiver or Transfer of Rights, and such other documents as may prove that the awardee has relinguished his/her right to the block/stall or table.

Section 7. Effectivity Clause. – This Ordinance shall take effect after Fifteen (15) Days after its publication in a newspaper of general circulation in the City of Bacolod.

AN ORDINANCE ALLOWING FOR THE TRANSFER OF AWARDS TO THE PRESENT MARKET BLOCK/STALL/TABLE OCCUPANTS.
WHEREAS, the provisions of the “CONTRACT OF LEASE” under City Ordinance # 160, series of 1996 or the Market Code of Bacolod City prohibit the transfer of awards or sub-leasing of blocks/ stalls/ tables, except in the case of death or legal incapacity of the awardee, in which case, the award maybe transferred to the surviving spouse, son or daughter or a business partner;
WHEREAS, approval by the Local Market Committee on application for transfers which were actually done in previous years have served as precedents to give the interested persons an impression that despite of clear provisions in the Market Code, transfer maybe made to an alleged business partners for causes other than death or legal disability;

AN ORDINANCE INSTITUTIONALIZING ARBOR DAY IN THE CITY OF BACOLOD, ENJOINING PARTICIPATION OF EVERYBODY, THEREOF, AND REQUIRING CITY SCHOLARS/SUMMER JOBBER STUDENTS & STUDENTS OF THE BACOLOD CITY COLLEGE TO PLANT AT LEAST TEN(10) SEEDLINGS EVERY YEAR.
WHEREAS, Section 6 of Article 4 of City Ordinance No. 313, otherwise known as the Environment Code of Bacolod City, states that, “the City of Bacolod shall conceive and implement a clean and green program xxx.” And, as such, all barangays shall conduct beautification drive in their respective jurisdiction, including the greening of street shoulders, planting trees and ornamental or herbal plants along the highways and placing flowers in front of residential and commercial houses, subject to existing rules & regulations;”
WHEREAS, the Local Government Code of 1991 mandates Local Government Units (LGUs) on the primacy of conservation, development, protection & preservation of the natural resources falling within their jurisdiction;
WHEREAS, Section 16 of Article II of the 1987 Philippine Constitution states that, “the State shall protect and advance the rights of every people to a balanced and healthful ecology in accord with the rhythm & harmony of nature;”
WHEREAS, also,section 13 of Article II of the Philippine Constitution states that, “the state recognizes the vital role of the youth in nation building xxx. It shall inculcate in the youth patriotism and nationalism, and encourage their involvement in public and civic affairs;”
WHEREAS, furthermore, Executive Order No. 26, series of 2011 of President Benigno Aquino III mandates for National Greening Program (NGP) that will spearhead to plant 1.5 billion new trees to a 1.5 million hectares of land identified thru the convergent offices of the Department of Agriculture, Department of Agrarian Reform and the Department of Environment & Natural Resources by the end of 2016. And, to ensure the success of tree planting under this E.O. 26, the NGP will require all students and government employees to individually plant a minimum of ten(10) seedlings every year;

WHEREAS, likewise, following theuniversal urgent response to environmental challenge, previous Presidential Proclamation No. 643 amended Proclamation 396 that declared June 25 as an Arbor Day which mandates to observe throughout the nation by planting trees & ornamental plants, and other forms of relevant activities, and likewise enjoined active participation of all government agencies, including government-owned or controlled corporations, schools, private sectors/non-governmental organizations(NGOs)/civil society groups and the citizenry in tree planting activities;
WHEREAS, along those lines, it is incumbent upon the Sangguniang Panlungsod of the City of Bacolod to enact an ordinance that will institutionalize Arbor Day, & celebration thereof, and also, establishing a continuous tree planting activities, especially among our young people and/ or students, most particularly among City scholars/summer-jobber students & students of the Bacolod City College(BCC) who were paid/supported by the City thru scholarship/grants thru colleges/universities or technical schools administered thru City’s budget, thereby sustaining City’s greening program in consonance with national environmental agenda, thereby sharing to safeguard future generations;
THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in Session, that:
Section 1. Title – The title of this ordinance shall be, “An Ordinance Institutionalizing Arbor Day in the City of Bacolod, Enjoining Participation of Everybody, Thereof, and Requiring City Scholars/Summer Jobber Students and Students of the Bacolod City College to Plant at Least Ten(10) Seedlings Every Year.”
Section 2 Definition of Terms
a Arbor Day – refers to an official holiday devoted for tree planting observed in all 50 States of the United States, usually in spring(WIKIPEDIA)
b. Executive Order 26, series of 2011 – refers to the Executive Order of His Excellency, President Benigno Aquino III the implementing of the National Greening Program as government priority.
Section 3. Local Policy –
a. The City abides to the global calls to actively campaign or advocate, continue to initiate, realize and implement tree planting activities. Relative thereto, the City shall observe all international environmental laws and/ or treaties signed by the Philippine Government.

b. Enforce environment laws, ordinances, policies and rules & regulations which protect, preserve & sustain the environment.
c. The City shall implement the clean & green program. Along this policy, all barangays are mandated to do their own tree planting activities by beautifying their own jurisdiction thru greening street shoulders of trees, flowers or herbs.
d. Vacant lots are hereby designated also as areas for the planting of trees, flowers or herbs.
e. To preserve & maintain the hygienic and sanitary condition of City’s human resettlement or relocation areas, its roads/street shoulders, including open spaces shall be considered for the greening of trees, fruit trees, flowers or herbs under this Ordinance.
f. The City may also enter into an agreement or MOA and/or usufruct with any private or juridical person for the tree planting program/project, especially for the creation or establishment of an urban forest where seedlings acquired thru this ordinance shall be planted;
g. The City recognizes the role of the youth and students in their civic and environmental participation, especially for continuing greening of City streets/roads shoulders, including open spaces & for the establishment of a green-belt areas along universities and colleges.
h. The City shall harness City scholars/summer-jobber students and City schools/BCC students for sustainable tree planting programs and/or projects.
Section 4. Declaration of City’s Arbor Day. – Thru this ordinance, the City declares on the last Saturday of June and Every Year thereafter as the City’s Arbor Day, following the Country’s and International annual observance on tree planting.
Section 5. Tree Planting Months. – For effective tree planting activities, the City hereby declares months of June, July, August & September as the tree planting months of every year, which shall kick-off from the last Saturday of June coincided with the Country’s & International annual observance.

Towards such declaration, every and all the people of Bacolod, local government agencies, barangays, private sectors & civil society groups and school, be it public or private, including government-owned or controlled corporations based in the City are hereby enjoined for their observance & active participation. And, thereof, may display streamers, placards, or any printed materials to give significance for this universal observance.
Section 6. Mechanics for Implementation of Tree Planting –City scholars/summer-jobber students and BCC students shall, upon the supervision of the PESO Head or the Bacolod City College Administrator, as the case may be, shall plant at least ten(10) seedlings during the stated tree planting months.
However, in the case of the summer-jobber students, upon the supervision of the PESO Head, they shall conduct tree planting activities during months of April & May, following their summer-job schedule.
Section 7. Supply of seedlings and Determination of Species & Site for Tree Planting – For tree planting purposes, City scholars/summer-jobber students and BCC students shall provide seedlings under this ordinance.
However, to ensure the supply of seedlings & other needs of the City, the ENRO is hereby mandated to create and establish a Seedling Nursery, and thereof, assign & detail a City-paid worker/s or laborer/s for maintenance.
For such stated purpose, the ENRO, with the City Agriculture Office shall determine the species of tree/seedlings needed for tree planting and scout, locate and which and what land/lot/place is suited for tree planting.
Section 8. Checking, Verifying & Issuance of Certification.– Recognizing the nature & status of the PESO Head and the BCC Administrator of their positive influence over the City Scholars/summer-jobber students and BCC Students, and, for the success of this Ordinance, it is therefore appropriate for them to check or cause to check and verify seedlings of each city scholar/summer-jobber student and BCC student planted. And, upon checked and verified, shall issue pertinent Certification to the scholar’s /summer-jobber student’s or BCC student’s concerned.
Section 9. Implementing Rules and Regulations(IRR). – A COMMITTEE under this ordinance shall be created to draft and come up with the Implementing Rules & Regulations Sixty(60) days upon the passage of this ordinance the Committee shall compose the following:

3.PESO Head
4. BCC School Administrator, and
5. Chairperson, Sangguniang Panlungsod Committee on Environment and Ecology
Such drafted IRR shall be submitted to the Sangguniang Panlungsod for ratification and/or appropriate action.
Section 10. Sources of Fund.
a. A budget item for “Maintenance of City Tree Park” under ENRO’s budget allocation shall be tapped and maximized for the intent and purposes of this Ordinance, and
b. To ensure the implementation of this ordinance, and for sustainable tree planting activities, a budget allocated for City Ordinance No. 346, series of 2003(An Ordinance Establishing the Bacolod City Nature’s Park in Barangay Alangilan) shall also be used for tree planting, especially for the Nature’s Park.
Section 11. Separability Clause – If any section or provision of this ordinance is declared invalid by competent Court, other sections or provisions, hereof, which is not affected shall remain valid, which has the force and effect.
Section 12. Effectivity Clause – This ordinance shall take effect immediately upon its approval.

And, to ensure the success of tree planting under this E.O. 26, the NGP will require all students and government employees to individually plant a minimum of ten(10) seedlings every year;

WHEREAS, likewise, following theuniversal urgent response to environmental challenge, previous Presidential Proclamation No. 643 amended Proclamation 396 that declared June 25 as an Arbor Day which mandates to observe throughout the nation by planting trees & ornamental plants, and other forms of relevant activities, and likewise enjoined active participation of all government agencies, including government-owned or controlled corporations, schools, private sectors/non-governmental organizations(NGOs)/civil society groups and the citizenry in tree planting activities;
WHEREAS, along those lines, it is incumbent upon the Sangguniang Panlungsod of the City of Bacolod to enact an ordinance that will institutionalize Arbor Day, & celebration thereof, and also, establishing a continuous tree planting activities, especially among our young people and/ or students, most particularly among City scholars/summer-jobber students & students of the Bacolod City College(BCC) who were paid/supported by the City thru scholarship/grants thru colleges/universities or technical schools administered thru City’s budget, thereby sustaining City’s greening program in consonance with national environmental agenda, thereby sharing to safeguard future generations;
THEREFORE, BE IT ORDAINED by the Sangguniang Panlungsod of the City of Bacolod in Session, that:
Section 1. Title – The title of this ordinance shall be, “An Ordinance Institutionalizing Arbor Day in the City of Bacolod, Enjoining Participation of Everybody, Thereof, and Requiring City Scholars/Summer Jobber Students and Students of the Bacolod City College to Plant at Least Ten(10) Seedlings Every Year.”
Section 2 Definition of Terms
a Arbor Day – refers to an official holiday devoted for tree planting observed in all 50 States of the United States, usually in spring(WIKIPEDIA)
b. Executive Order 26, series of 2011 – refers to the Executive Order of His Excellency, President Benigno Aquino III the implementing of the National Greening Program as government priority.
Section 3. Local Policy –
a. The City abides to the global calls to actively campaign or advocate, continue to initiate, realize and implement tree planting activities. Relative thereto, the City shall observe all international environmental laws and/ or treaties signed by the Philippine Government.

b. Enforce environment laws, ordinances, policies and rules & regulations which protect, preserve & sustain the environment.
c. The City shall implement the clean & green program. Along this policy, all barangays are mandated to do their own tree planting activities by beautifying their own jurisdiction thru greening street shoulders of trees, flowers or herbs.
d. Vacant lots are hereby designated also as areas for the planting of trees, flowers or herbs.
e. To preserve & maintain the hygienic and sanitary condition of City’s human resettlement or relocation areas, its roads/street shoulders, including open spaces shall be considered for the greening of trees, fruit trees, flowers or herbs under this Ordinance.
f. The City may also enter into an agreement or MOA and/or usufruct with any private or juridical person for the tree planting program/project, especially for the creation or establishment of an urban forest where seedlings acquired thru this ordinance shall be planted;
g. The City recognizes the role of the youth and students in their civic and environmental participation, especially for continuing greening of City streets/roads shoulders, including open spaces & for the establishment of a green-belt areas along universities and colleges.
h. The City shall harness City scholars/summer-jobber students and City schools/BCC students for sustainable tree planting programs and/or projects.
Section 4. Declaration of City’s Arbor Day. – Thru this ordinance, the City declares on the last Saturday of June and Every Year thereafter as the City’s Arbor Day, following the Country’s and International annual observance on tree planting.
Section 5. Tree Planting Months. – For effective tree planting activities, the City hereby declares months of June, July, August & September as the tree planting months of every year, which shall kick-off from the last Saturday of June coincided with the Country’s & International annual observance.

Towards such declaration, every and all the people of Bacolod, local government agencies, barangays, private sectors & civil society groups and school, be it public or private, including government-owned or controlled corporations based in the City are hereby enjoined for their observance & active participation. And, thereof, may display streamers, placards, or any printed materials to give significance for this universal observance.
Section 6. Mechanics for Implementation of Tree Planting –City scholars/summer-jobber students and BCC students shall, upon the supervision of the PESO Head or the Bacolod City College Administrator, as the case may be, shall plant at least ten(10) seedlings during the stated tree planting months.
However, in the case of the summer-jobber students, upon the supervision of the PESO Head, they shall conduct tree planting activities during months of April & May, following their summer-job schedule.
Section 7. Supply of seedlings and Determination of Species & Site for Tree Planting – For tree planting purposes, City scholars/summer-jobber students and BCC students shall provide seedlings under this ordinance.
However, to ensure the supply of seedlings & other needs of the City, the ENRO is hereby mandated to create and establish a Seedling Nursery, and thereof, assign & detail a City-paid worker/s or laborer/s for maintenance.
For such stated purpose, the ENRO, with the City Agriculture Office shall determine the species of tree/seedlings needed for tree planting and scout, locate and which and what land/lot/place is suited for tree planting.
Section 8. Checking, Verifying & Issuance of Certification.– Recognizing the nature & status of the PESO Head and the BCC Administrator of their positive influence over the City Scholars/summer-jobber students and BCC Students, and, for the success of this Ordinance, it is therefore appropriate for them to check or cause to check and verify seedlings of each city scholar/summer-jobber student and BCC student planted. And, upon checked and verified, shall issue pertinent Certification to the scholar’s /summer-jobber student’s or BCC student’s concerned.
Section 9. Implementing Rules and Regulations(IRR). – A COMMITTEE under this ordinance shall be created to draft and come up with the Implementing Rules & Regulations Sixty(60) days upon the passage of this ordinance the Committee shall compose the following:

2. City Agriculture Officer
3.PESO Head
4. BCC School Administrator, and
5. Chairperson, Sangguniang Panlungsod Committee on Environment and Ecology
Such drafted IRR shall be submitted to the Sangguniang Panlungsod for ratification and/or appropriate action.
Section 10. Sources of Fund.
a. A budget item for “Maintenance of City Tree Park” under ENRO’s budget allocation shall be tapped and maximized for the intent and purposes of this Ordinance, and
b. To ensure the implementation of this ordinance, and for sustainable tree planting activities, a budget allocated for City Ordinance No. 346, series of 2003(An Ordinance Establishing the Bacolod City Nature’s Park in Barangay Alangilan) shall also be used for tree planting, especially for the Nature’s Park.
Section 11. Separability Clause – If any section or provision of this ordinance is declared invalid by competent Court, other sections or provisions, hereof, which is not affected shall remain valid, which has the force and effect.
Section 12. Effectivity Clause – This ordinance shall take effect immediately upon its approval.

WHEREAS, the Sangguniang Panlungsod has passed & approved City Ordinance # 387, series of 2005 as amended;
WHEREAS, present health challenge calls to review for the pertinent section of such Ordinance in the light of the common diseases, such as TB where 75 filipinos died each day and which Philippines ranked 9th of the 22 high burdened tuberculosis countries in the world;
WHEREAS, while the World Health Organization (WHO) report showed that the Philippines has slight increase in TB cure, nevertheless, the same report stated that provinces (Bacolod is included) remain below due to the systemic and social factors;
WHEREAS, that systemic and social factors are attributed to the capacity of our ordinary people, especially our under-privileged and/or indigents to access health services, particularly on the early detection and prevention of common diseases, such as TB;
WHEREAS, in many cases, a lot of TB carriers and patients in our City have not been able to be diagnosed on the early detection and prevention of this illness because they (patients) cannot even afford to pay even just for an X-ray;
NOW THEREFORE, be it ordained by the Sangguniang Panlungsod in Session assembled, that:
Section 1. Paragraph C4 under 12 C & E of Section 1 of Ordinance 387, series of 2005 as amended is hereby further amended to read as:
Indigents living in the City of Bacolod shall be exempted to pay on the following X-ray fees:
C4 Chest PA or AP - P100.00
E. For purposes of this Ordinance, charges for the Pathologist who is not a government employee to the indigents who avail of this exemption shall be 30.00 per X-ray.

Section 2. Criteria/Requirements of Availing Fees Exemption – The criteria/ requirements of availing of these fees exemption are the following:
1) Certificate of Indigency duly signed by the Punong Barangay or indigents who possess Philhealth Card.
2) And, Voter’s ID, as registered voter of Bacolod City or in its absence, a master-list of voters whose name of patient appeared thereon. And, in case, patient is child or minor, voter’s ID or a master-list of voters whose name of his/her parent as appeared thereon is enough.
Section 3. Penalty – Any concerned personnel who in one way or the other, deliberately or a neglect violate this Ordinance shall be subject to a disciplinary action, pursuant to the Civil Service laws or thru an administrative action.
Section 4. Separability Clause – If any clause or section of this Ordinance is declared void or invalid by a competent Court of jurisdiction, the remaining clause or section thereof which is not affected, thereby shall remain valid and has a force and effect.
Section 5. This ordinance shall take effect immediately upon approval.

WHEREAS, except for item No. 12 “Chest X-ray” which was duly & properly amended also, all enumerated items hereof under such ordinance are still in effect;
WHEREAS, in any cure of whatever types of diseases, laboratory is indispensable for finding & treatment of patients;
WHEREAS, patients, especially our under-privileged and/or indigents who are inadequate to pay for laboratory fees would therefore in effect denied the rights for basic health services;
WHEREAS, such sad state of our under-privileged and/or indigents contradicts to our international laws-as stated in the “Universal Rights declaration”, the “Social Justice provision of 1987 Philippine Constitution” and the “general welfare clause” of the Local Government Code of 1991.
NOW THEREFORE, be it ordained by the Sangguniang Panlungsod in Session assembled, that:

AN ORDINANCE AMENDING SECTION 2 OF CITY ORDINANCE NO. 361, SERIES OF 2004, ‘AN ORDINANCE AMENDING CERTAIN SECTIONS OF CITY ORDINANCE NO. 290, SERIES OF 2001, KNOWN AS ‘AN ORDINANCE ESTABLISHING SERVICE FEE FOR LABORATORY AND ANCILLARY SERVICES.
WHEREAS, the Sangguniang Panlungsod has passed & approved City Ordinance # 361, series of 2004 as amended;
WHEREAS, it is a fact that thru this ordinance, the City thru the City Health Office extends basic health services to the people of Bacolod, and one of these services is the dental service;
WHEREAS, most of our under-privileged and/or indigents wanting to avail of the dental service, particularly for the dental extraction, especially when they are in dire need of such service, however cannot afford to pay for the required fee;
WHEREAS, in addition, with the present exigency where our under-privileged and/or indigents from various sectors are coping for their daily survival needs, freeing them from this fee would diminish their burden, and ultimately give them more access to this kind of health services.
NOW THEREFORE, be it ordained by the Sangguniang Panlungsod in Session assembled, that:
Section 1. Item E) under 14 Dental fees, Section 2 of City Ordinance # 361, series of 2004, as amended, is hereby further amended to read as:
Indigents living in the City of Bacolod shall be exempted to pay fees for dental extraction:
E) Dental Extraction - P85.00
Section 2. Criteria/Requirements of Availing Fee Exemption – The criteria/ requirements of availing this fees exemption are the following:
1) Certificate of Indigency duly signed by the Punong Barangay or indigents who possess Philhealth Card.

2) And, Voter’s ID, as registered voter of Bacolod City or in its absence, a master-list of voters whose name of patient appeared thereon. And, in case, patient is child or minor, voter’s ID or a master-list of voters whose name of his/her parent as appeared thereon is enough.
Section 3. Penalty – Any concerned personnel who in one way or the other, deliberately or a neglect violate this Ordinance shall be subject to a disciplinary action, pursuant to the Civil Service laws or thru an administrative action.
Section 4. Separability Clause – If any clause or section of this Ordinance is declared void or invalid by a competent Court of jurisdiction, the remaining clause or section thereof which is not affected, thereby shall remain valid and has a force and effect.
Section 5. This ordinance shall take effect immediately upon approval.
