Three Kagawads of Barangay Alangilan in Bacolod City have requested the Bacolod Sangguniang Panlungsod to allow them to appear at its regular session today to air their opposition to the construction activity at the Metro Safari Resort despite their vehement opposition to its its failure to comply with the mandatory requirements of the law.
Kagawads Donard Alimpolo, Alex Sauci and Roy Retiza, in a letter to the SP, said Metro Safari Resort in Brgy. Alangilan has not complied the required Environmental Compliance Certificate, building permit, and City Planing and Development Office clearance . They said that, despite the order of the Sanggunian for the immediate stoppage of the construction activities on the site, it is being continued, in open and blatant defiance of the authority of the Barangay Council of Alangilan and the City of Bacolod. Worse, the Office of the Building Official did not lift a finger to stop the on-going construction that was witnessed by no less than Councilor El Cid Familiaran and themselves, they said. The illegal construction continues to be committed by the owner in apparent violation of PD 1096 and in complete disregard of the mandate of the City Council. They therefore are requesting for an opportunity to appear before the Council with acting OBO head Isidro Sun who allegedly continues to ignore and disregard the Resolution of the Sanggunian and Barangay Council to stop the illegal construction, the kagawads also said. They also requested the presence of Police Station 5 Commander as the construction continues to violate P.D.1096 and is being done in "flagrante delicto" by the owner and the contractor. Thus, they also said, the police officers and even private citizens can effect a citizen's arrest against these violators who feel that they are over and above the law. Meanwhile, Sun said they have already issued Metro Safari Resort a notice of violation after an inspection conducted by their building inspector in the area Saturday, since the resort had also failed to secure a business permit for the construction of the foundation of a water tank. Sun said the notice of violation was received by a representative of Metro Safari Resort Monday and if there is no compliance after 15 working days, they will issue a second notice of violation. If the resort owners still fail to comply with the requirements after 15 days, a third and final notice will be issued after which, he will endorse the matter to the City Legal Office, he added.*CGS
