BACOLOD City – Following the suspension of Mayor Monico Puentevella, his appointees – executive assistants and co-terminus employees – were urged to tender their courtesy resignations to Acting Mayor Greg Gasataya. Gasataya must be given a free hand to reorganize and run the city government as he sees fit, explained Councilor Caesar Distrito. A day after taking his oath as acting mayor, Gasataya wasted no time effecting a revamp covering three department heads. But Distrito said Gasataya must not stop there. Gasataya yesterday ordered Atty. Maphilindo Polvora, city legal officer, to return to his original assignment – as city assessor. Six months ago, Puentevella reassigned Polvora to the City Legal Office. That time, there were intense discussions on the plan to dispose the city government’s property where the Manokan Country stood. Polvora was tasked to lead an appraisal committee. After receiving Gasataya’s order, Polvora vowed to continue enforcing the new real property tax code as city assessor. General Services Office head Jerome Solinap, meanwhile, was removed as concurrent acting city administrator. He was replaced by City Agriculture Office head Goldwyn Nifras, who was appointed in a concurrent capacity. Gasataya also named Nelson Sedillo as new chief of the city’s Department of Public Services. Councilor Distrito said Gasataya as acting mayor can appoint or fire all executive assistants, job order, plantilla or casual employees if he wants to. Executive assistants and co-terminus employees are hired based on trust and confidence they enjoy with the appointing authority, explained Distrito. Their terms are also the same with their appointing authority, he added. The possibility of being fired got varied reactions from Puentevella’s executive assistants. Bacolod Traffic Authority head Reynaldo Ebreo said he is willing to step down. But he urged Gasataya to seek legal opinion first. “If the law says he can remove employees, he won’t have any problem with me,” said Ebreo. He won’t force himself on anybody who does not like him, he said. Executive Assistant Sarah Esguerra, on the other hand, said she will not resign. Puentevella was only placed under preventive suspension and will return after 90 days, she stressed. “We are not (included) in the suspension order so we will continue to work,” said Esguerra. She urged Gasataya to be “humane” and vowed to work with him in a professional manner. On Nov. 16, Puentevella started serving his 90-day preventive suspension as ordered by the Sandiganbayan’s Fourth Division. Vice Mayor Gasataya and Councilor El Cid Familiaran immediately took their oaths as acting mayor and vice mayor, respectively. Gasataya assumed all the duties, responsibilities and power of the city mayor, including the authority to hire and fire employees, said Distrito. Douglas MacArthur in his message that was read by his son Councilor Claudio Puentevella, during a press conference yesterday at the annex building of the People's House (Bacolod City Government Center), who was with his mother, Bacolod First Lady Josefa Puentevella. “Today I peacefully received the Sandiganbayan order with a belief that everything happens for a reason. Our God works in mysterious ways and His will be done,” Mayor Puentevella said in his press statement dated November 17. Mayor Puentevella said this is a journey that he must take. And despite the sentiments of his followers, he asked the people to remain calm and focus their efforts on making Bacolod better. “Deep in my heart I know I am innocent and in the end, I know we will be vindicated. Do not be sad for me, instead be mad that the forces of evil are out there to destroy our gains,” he said. Vice Mayor Greg Gasataya and Councilor El Cid Familiaran were sworn into office as acting mayor and acting vice mayor, respectively, after Mayor Puentevella was served a 90-day suspension order by the Department of Interior and Local Government Monday, in compliance with a Sandiganbayan Fourth Division order. The graft case filed against Puentevella by the late City Legal Officer Allan Zamora stemmed from the alleged overpriced purchase of computers and software packages at P400,000 each, all worth P26 million in 2001 to 2006, funded from the suspended mayor's Priority Development Assistance Fund, or pork barrel, during his incumbency as congressman of Bacolod City. Meanwhile, Josefa Puentevella said that the incident was one of the saddest moments in her life, especially in the 12 years she spent with the Mayor during his 12-year service with the government. “What we can do now is to reflect on the situation. God will still give Mayor Monico enough time to finish what he started,” she said. Josefa said “We hope you would reflect on what has happened to us. On the other hand Joselito Bayatan, a nominal complainant in the IT package case, said a nyone who faces prosecution in court can always claim innocence. To invoke God while justice is working is the most appropriate reflection one can have, he said. To be sad when the effect of justice does not favor him is natural. But to call the supporters to be mad because there are forces of evil out to destroy his alleged gains displaces the prior invocation of God and betrays the claim of one's innocence, Bayatan said. God and justice are one in speaking the truth, and evil has no role to be integrated with them because the matter of the mayor's suspension is the truth prevailing in this situation that remains unchangeable and unjustifiable, no matter what may be said about it, he said. When the mayor says “I shall return,” what is there to return? Bayatan asked. “We can only quote Winston Churchill when he said “The truth is incontrovertible. Malice may attack it, ignorance may deride it, but in the end, there it is”. Bayatan said the court has spoken that Mayor Puentevella is suspended. No amount of explanation can undo the incriminating facts of corruption. What he owes to the people of Bacolod is a sincere apology coming from the members of his family, he said. The people are not foolish to connect the authority of the court with politics. If Mayor Puentevella is showing that he cannot apologize while insisting politics in his suspension as he can no longer discern the moral import of his suspension, then we can expect the worse governance when he comes back, Bayatan said. This will only further encourage the people to be more vigilant, he said. “Meanwhile, we feel sorry for ourselves for having an unapologetic mayor,” Bayatan added. On the other hand, acting Mayor Greg Gasataya said he has not yet thought of replacing executive assistants and job order casuals as there are other priority concerns to attend to. The mayor was finally served with the order from the Sandiganbayan suspending him for three months while the anti-graft court hears his case for the alleged overpricing of computers distributed to public schools. After a delay of nearly two months, Department of Interior and Local Government (DILG) regional director Anthony Nuyda served the suspension order at Puentevella’s house in Barangay Villamonte here. Nuyda was accompanied yesterday by DILG Region 6 legal officer Cedric Jaranilla and DILG Bacolod City director Cheryl Tacda Puentevella personally received the suspension order, said Nuyda. The DILG officials were supposed to serve the suspension order at the mayor’s office at city hall but they were informed that Puentevella was not there. From the mayor’s house, the DILG officials then proceeded to the People’s House to implement the memorandum appointing Vice Mayor Greg Gasataya and Councilor El Cid Familiaran as acting mayor and vice mayor, respectively. Gasataya and Familiaran immediately took their oaths of office before Judge Montano Medel. Citing Section 46 of the Local Government Code of 1991, Nuyda said both officials will remain in their acting capacities while Puentevella is suspended. Puentevella is expected to return to the People’s House by the middle of February 2016. The Fourth Division of the Sandiganbayan ordered the mayor’s suspension on Sept. 28, 2015 yet but Puentevella managed to stall its implementation. He filed a motion for reconsideration and later sought a temporary restraining order from the Supreme Court. But he failed to get favorable rulings. Puentevella is accused of using P26 million of his Priority Development Assistance Fund when he was the city’s congressman from 2002 to 2006 to finance and alleged overpriced information technology packages to public schools here. “My position is just temporary. I am making an appeal to all employees to do what is good for 90 days,” Gasataya said after taking his oath of office.
