Some provisions of City Ordinance 37 Series of 1987 regarding creation of Brgy. Paglaum in Bacolod City were amended/added through the Resolution authored by Coun. Caesar Distrito, duly approved by members of the sangguniang panlungsod during the mid-week session.
A series of public hearings conducted by Coun. Distrito, chair, committee on laws, ordinances and good government, was conducted in response to the request of petitioners from Paglaum Village. The amendments on the said ordinance include: the new date of the plebiscite, the appointment of the barangay officials, and the boundaries, were technically identified by the City Planning and Development Office of Bacolod. Instead of involving Brgy. Vista Alegre in the plebiscite, only one barangay is involved which is Brgy.Mansilingan, to reduce the cost of plebiscite. Involving two barangays for the plebiscite, Distrito said, is such a big burden for the city in terms of the cost of its implementation, because based on the estimates of the COMELEC, it would be around Six Million Pesos (Php 6, 000, 000. 00). Plebiscite expenses will be appropriated by the Bacolod City government amounting to P5 million only, taken from the general fund. The new barangay to be known as Barangay Paglaum will be composed of: Paglaum Village, Sitio Buri, Hda. Guanzon, Hda. Hojilla, Hda. Tanalgo and Miranda, Hda. Green Farm, Hda. Nieves, Hda. De Leon, Hda. Garcia, Hda. Fortaleza, Hda. Martir, Hda. Cuison, Hda. De Leon, Hda. Arceo-Ramos, Hda. Montinola, and Mabesa Subdivision. Amended coverage areas: ESTEBAN GUANZON: Hda. ARGG Agri Dev. Corp.; Hda. Lopuez Realty Corp.; Lolita Hts. Subdivision; Land Hts. And Iloilo Dev. Corp; NAPOCOR (National Power Corp. Sub-station); Hda. Magdalena; Esteban Village Subdivision; Hda. Villarosa; Hda. PATRICIO MARTIR A plebiscite to be participated in by residents of Barangay Mansilingan shall be held on December 15, 2012, instead of February 27. The conduct of the plebiscite shall be administered by the Commission on Elections (COMELEC) Local Office. Manayaosayao I (Concepcion Hojilla) going south intersecting and traversing Cabungan-an Creek and Hda. Patricio Martir of lots 1570 and 1571, thence following the property boundary of Hda. Amending the previous provision, the officials shall be elected or appointed in accordance with existing laws. Instead, Immediately after the plebiscite approves the creation of the new barangay, the City Mayor shall appoint the Barangay Officials for the said barangay including members of its Sanggunian and the Sangguniang Kabataan Officials in accordance with existing laws, rules and regulations. The appointed officials shall serve only until the assumption of the new set of barangay officials have been elected during the local barangay elections. Appointed Officials, as prescribed by law, shall be allowed to become candidates on the said elections. Also added in the provisions: The corporate existence of the barangay shall commence upon the appointment and qualification of its chief executive and a majority of the members of its Sanggunian. If any provision of this ordinance or the application thereof, to any person or circumstances is held invalid, the remainder of this ordinance and the application of such provision to other persons or circumstance shall not be affected.
